Terms of Service

By creating an account or otherwise using LoyeeCards, you agree to these Terms of Service (“Terms”) and to our Privacy Policy. If you do not agree, do not use the service.
1. The service
LoyeeCards is a software-as-a-service platform that lets businesses (“vendors”) issue digital loyalty cards to their own customers. Cards are delivered to customer phones via Apple Wallet and Google Wallet. The service is operated by Matej Valtr, an individual sole trader based in the Czech Republic.
2. Eligibility
- You must be at least 18 years old to use LoyeeCards as a vendor.
- You must own, or be authorized to operate on behalf of, the business you register.
- You are responsible for keeping your login credentials secure.
3. Vendor responsibilities
As a vendor, you are responsible for the customers you enroll into your own loyalty program through LoyeeCards. In particular:
- You are the data controller for your customers’ personal data. We act as your data processor for that data, under these Terms.
- You must comply with applicable law — including data protection, consumer protection, and tax law — in the jurisdictions where you operate.
- You must not use the service to send unsolicited or unlawful communications.
- You may not impersonate another business, misrepresent your identity, or register a venue you do not own or operate.
4. Acceptable use
You agree not to:
- attempt to reverse-engineer, decompile, or circumvent the service;
- interfere with or disrupt the service, our servers, or other users’ accounts;
- upload malware, illegal content, or infringing material;
- use the service for any unlawful purpose or in violation of these Terms.
5. Plans, billing, and cancellation
- Free: up to 10 customer passes per account.
- Premium: paid monthly. Includes additional capacity and features as described on the billing page.
- Pro: paid monthly. Includes further capacity and features as described on the billing page.
Paid subscriptions renew automatically until cancelled. You can cancel at any time from the billing portal; access continues until the end of the current billing period. If a payment fails, your account may be suspended after a grace period.
6. Customer accounts on the service
When a customer enrolls at a vendor’s venue via /join/<slug>, we create a customer record so we can issue and update their loyalty pass. Customers can request deletion of their data at any time by emailing support@loyeecards.com.
7. Intellectual property
We retain all rights to the LoyeeCards software, brand, and content that we produce. You retain all rights to your venue content (name, logo, design choices, customer data). You grant us a limited licence to host, process, and display your content only as necessary to provide the service.
8. Suspension and termination
- We may suspend or terminate accounts that violate these Terms or remain unpaid after the grace period.
- You may terminate your account at any time. Your data will be deleted within 30 days of termination, subject to any retention obligations under applicable law.
9. Disclaimer
The service is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or suitable for any specific purpose.
10. Limitation of liability
To the maximum extent permitted by applicable law, our total aggregate liability arising from or related to the service shall not exceed the amount you paid us in the twelve (12) months immediately preceding the event giving rise to the liability. We shall not be liable for indirect, incidental, consequential, or punitive damages.
11. Changes to the service or Terms
We may modify the service or these Terms from time to time. Material changes will be notified to vendors by email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the Czech Republic, without regard to its conflict-of-law provisions. The courts of the Czech Republic have exclusive jurisdiction over any dispute.
